1. Introduction and Commitment

At Olgas Friends LLC, doing business as Blackburn Business Capital ("BBC," "we," "us," or "our"), we prioritize the privacy of our customers, prospective customers, and all consumers who interact with our business. We adhere to all applicable federal, state, and local laws governing telephone and electronic communications, including the Telephone Consumer Protection Act ("TCPA"), the Telemarketing Sales Rule ("TSR"), and applicable state laws.

This Do Not Call Policy outlines:

2. Scope of This Policy

This Policy applies to all communications initiated by BBC, our employees, agents, representatives, contractors, vendors, lender partners, funding partners, servicing partners, marketing partners, and any third parties acting on our behalf (collectively, "Authorized Callers"). It covers:

This Policy is designed to comply with applicable telephone communication laws, including:

Under the TCPA, "telemarketing" is defined as "the initiation of a telephone call or message for the purpose of encouraging the purchase or rental of, or investment in, property, goods, or services." The law restricts cold calls and texts, prerecorded sales calls (including ringless voicemails), and the use of autodialers without varying levels of prior express consent.

FCC 2015 Order on Revocation of Consent: The Federal Communications Commission has ruled that consumers may revoke consent to receive calls and messages at any time and through any reasonable means that clearly expresses a desire not to receive further communications. BBC honors this principle without exception.

4. How to Opt Out

Opt Out of BBC Communications

You may request that BBC and our Authorized Callers stop calling, texting, emailing, or otherwise contacting you at any time, by any of the following methods:

  1. Text Message: Reply "STOP," "UNSUBSCRIBE," "CANCEL," "END," or "QUIT" to any SMS/MMS message you receive from BBC.
  2. Email: Send an email to legal@bbizcap.com with the subject line "OPT OUT" or "DO NOT CALL." Include your name, address, telephone number(s), and email address(es) to be removed.
  3. Marketing Email Unsubscribe: Click the "unsubscribe" link in any marketing email you receive from BBC.
  4. Phone: Call (954) 280-3922 and verbally request placement on BBC's Internal Do Not Call List. You may make this request during any call with a BBC representative.
  5. Mail: Send a written request to:

    Blackburn Business Capital
Attn: Legal Department / Do Not Call
    1520 E Sunrise Blvd
    Fort Lauderdale, FL 33304

Your request should identify the specific telephone numbers, email addresses, and/or names to be added to BBC's Internal Do Not Call List. If you do not specify, BBC will add all known contact information associated with you to the list.

4.1 National Do Not Call Registry

You may also register your residential or wireless telephone number on the National Do Not Call Registry maintained by the Federal Trade Commission:

Registration on the National Do Not Call Registry restricts most telemarketing calls. However, registration does not automatically prevent calls from businesses with which you have an "established business relationship" or to which you have given prior express written consent. To stop calls from BBC specifically, use the opt-out methods above in addition to (or instead of) the National Registry.

4.2 State Do Not Call Lists

Some states maintain their own Do Not Call lists. Contact your state attorney general's office or consumer protection agency for information about state-level registrations.

5. BBC's Internal Do Not Call List

BBC maintains an Internal Do Not Call List in accordance with TCPA and TSR requirements. When you submit an opt-out request through any of the methods described above:

Note: Opting out of telemarketing communications does not prevent BBC from contacting you for non-telemarketing purposes related to an existing financing application or financing relationship (see Section 10 below).

6. BBC Calling and Texting Rules

BBC and our Authorized Callers follow strict rules when making telephone calls and sending text messages, including:

6.1 Calling Hours

6.2 Caller Identification

6.3 Express Written Consent

6.4 Opt-Out Mechanism in Every Message

7. Prohibited Practices

The following practices are strictly prohibited for BBC personnel and Authorized Callers, in accordance with the TCPA, TSR, and BBC internal policy:

8. Third-Party Vendors and Lender Partners

BBC works only with third-party vendors, lead generators, telemarketing service providers, and lender partners that are TCPA-compliant. Specifically:

9. Response Time

BBC processes opt-out requests promptly. Specifically:

Once added to BBC's Internal Do Not Call List, opt-outs remain in effect indefinitely unless and until you provide subsequent affirmative consent to resume communications.

10. Effect on Existing Financing

Opting out of telemarketing and promotional communications does not affect BBC's ability to contact you for non-telemarketing purposes related to:

If you wish to opt out of all communications (including transactional and servicing communications), please indicate this explicitly in your opt-out request. Note that opting out of transactional communications may limit BBC's ability to provide services to you and may affect any existing financing arrangements.

You may also file complaints with regulatory authorities, including:

12.4 Private Right of Action
